Real Estate Settlement Procedures Act

boxReal Estate Settlement Procedures Act is a consumer protection Act passed by United States Congress in 1974 coded at title 12 chapters 27 of United States code and became effective from January 20, 1975. The Act requires lenders, mortgage brokers, or servicers of home loans to provide borrowers with pertinent and timely disclosures regarding the nature and costs of the real estate settlement process. The Act also protects borrowers against certain unusual activity, such as making an illegal payment, agreement for advance here we transfer property or money to a third party or put in trust by one party to a contract to be returned after fulfillment of the condition and other contractual mismatch. Inflating the costs of real estate transactions and obscuring price competition by facilitating bait-and-switch tactics. The Department of Housing and Urban Development (HUD) promulgated Regulation X (24 CFR 3500), which implements RESPA. The Act prohibits kickbacks between lenders and third-party service agents in the settlement process (Section 8 of RESPA). Even all these unusual activities and reciprocal referrals among these types of professions could be construed in court as a violation of the law of RESPA. RESPA requires that borrowers receive disclosures all transactions for all the times. RESPA also prohibits the activities that increase the cost of settlement. Section 8 of RESPA prohibits a person from giving or accepting any thing in value term for referrals of settlement related mortgage loan. It also prohibits a person from giving or accepting any part of a charge for services that are not performed. Section 9 of RESPA prohibits sellers from requiring real estate buyers to purchase title insurance from a particular company. It requires lenders to provide a good faith estimate (GFE) for all kinds of costs for a particular loan and finally for purchase real estate loans or for refinances of real estate loans at the closing of the real estate loan. Those practices allows the borrower to know specifically all the costs (including the hidden cost also) of a particular real estate loan.
